Eden secures fair competition in German Shelving Market

We wish to inform you that Eden has been engaged in a protracted legal battle with one of its competitors to ensure the German market remains open for multiple providers of 50mm pitch shelving, thereby preventing a monopoly situation from arising. We are pleased to provide you with an update on the latest developments in this case. The German court (Landgericht Koeln) has just issued a new ruling on Monday, October 9th, 2023. In summary, the decision entails the following:

A) The scope of the previous court decision from June 4, 2021, by the Oberlandesgericht Koeln has been clarified and is significantly narrowed. It only applies to certain components of the Eden system. This signifies that all other parts of the Eden system were (and are) unaffected by this prior court decision and thus are entirely free for sale in Germany, as well as in any other country worldwide.

B) There are no legal impediments to selling parts that initially fell under the scope of the previous court decision, as long as quality and compatibility issues are remedied by a redesign.

We would like to assure you that all affected parts have already undergone such redesign. Hence, there are no legal constraints on the use of the Eden shelving system on the German market moving forward.
